Client Video Testimonial Terms & Conditions

Client is the undersigned individual (“Client”). Company is Alex Stoykov Group Inc. (“Company”).

1) Consent to Record

Client authorizes Company to record, photograph, and capture Client’s appearance, voice, and statements in connection with the Testimonial. Recording may include video, audio, still images, behind-the-scenes footage, and screen captures.

2) Rights Granted (Worldwide, Perpetual, Internet-Ready)

Client grants Company a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable right and license to:

  • use, reproduce, publish, post, distribute, transmit, broadcast, stream, display, publicly perform, and otherwise exploit the Testimonial;

  • edit, cut, rearrange, caption, subtitle, transcribe, add music/graphics, create excerpts/teasers, and create derivative works from it;

  • combine it with other content, advertisements, or marketing materials;

  • use it in any media format now known or later developed, including without limitation: websites, landing pages, email, SMS/MMS, presentations, events, MLS/brokerage materials, print, PR, and all social platforms (e.g., Instagram, TikTok, YouTube, Facebook, LinkedIn), paid or organic distribution.

3) Use of Name, Likeness, and Identifiers

Client authorizes Company to use Client’s name, image, likeness, voice, biographical details, and/or neighborhood/general location in connection with the Testimonial. Company may also use captions and on-screen identifiers (e.g., first name + neighborhood) unless Client requests otherwise in writing before filming.

4) No Approval Rights

Client understands Company is not required to provide the Testimonial to Client for review or approval before publication. Company may, at its discretion, share a draft for courtesy review, but is not obligated to incorporate feedback.

5) Ownership

Company owns all right, title, and interest in the recordings and finished deliverables (including raw footage, edited cuts, audio, stills, captions, and transcripts), subject to the rights granted by Client in this agreement.

6) No Compensation

Client understands there is no payment, fee, commission, discount, gift, or other compensation provided in exchange for participation or for any review/testimonial. Participation is voluntary.

7) Release of Claims

To the maximum extent allowed by law, Client releases and agrees not to bring claims against Company (and its agents, employees, contractors, and partners) arising out of the creation, editing, publication, distribution, or use of the Testimonial, including claims for:

  • invasion of privacy, right of publicity, defamation, or misappropriation;

  • alteration, optical effects, or editorial decisions;

  • loss of control over the content once published or shared by third parties.

8) Client Promises (Important)

Client represents and warrants that:

  • Client is 18 years or older and has legal capacity to sign (or a parent/guardian will sign below).

  • Client’s statements reflect Client’s honest experience and opinions.

  • Client will not knowingly share confidential information, private financial details, medical details, or information that belongs to third parties.

  • Client will not include content that is unlawful, harassing, discriminatory, threatening, or knowingly false.

  • Client’s participation does not violate any agreement with an employer, brand, or other third party.

9) Results Disclaimer

Client understands real estate outcomes vary. The Testimonial is not a guarantee of performance, price, timelines, or results. Any statements are personal experience, and Company may add compliance disclaimers where appropriate.

10) Removal Requests

Client may submit a written request to stop using the Testimonial in future marketing. Company may honor such requests at its discretion, but:

  • Company is not required to remove content already printed, distributed, syndicated, archived, or shared by third parties;

  • Company cannot guarantee complete removal from the internet, search engines, caches, or reposts by others.

11) Governing Law

This agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

12) Entire Agreement; Electronic Signature

This document is the entire agreement regarding the Testimonial and supersedes any prior discussions. Electronic signatures and checkbox acceptance are valid and enforceable.
